1. Acceptance of Terms

By accessing or using Cigars Amigos ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement and that cigar-related content is legal in your jurisdiction.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must not share your account or passkey with others
  • You must notify us immediately of any unauthorized access
  • One account per person; duplicate accounts may be terminated

4. Acceptable Use

You agree not to:

  • Post content that is illegal, harmful, threatening, abusive, or hateful
  • Impersonate any person or entity
  • Upload viruses, malware, or other malicious code
  • Scrape, crawl, or collect data from the Service without permission
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for commercial purposes without authorization
  • Harass, bully, or intimidate other users
  • Post spam or unsolicited promotional content

5. User Content

You retain ownership of content you create (reviews, posts, photos). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the Service.

We reserve the right to remove content that violates these terms or is flagged as inappropriate by the community.

6. Intellectual Property

The Service, including its design, logos, and features, is owned by Cigars Amigos. You may not copy, modify, or distribute any part of the Service without prior written consent. Cigar brand names and images belong to their respective owners.

7. Disclaimers

  • The Service is provided "as is" without warranties of any kind
  • We do not guarantee the accuracy of user-submitted reviews or ratings
  • We are not responsible for the quality of products at listed shops or lounges
  • Cigar information in our catalog is for reference purposes only
  • Event attendance is at your own risk

8. Limitation of Liability

To the maximum extent permitted by law, Cigars Amigos shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

9. Payments, Ticketing and Event Organisers

What may be sold through the Service. The Service may be used to sell only: admission to events, tastings, competitions and educational masterclasses; memberships and software subscriptions; and related platform or service fees.

What may never be sold through the Service. You must not use the Service, or any payment account connected through it, to sell, ship, distribute or facilitate the sale of any physical goods, including but not limited to cigars, tobacco, e-cigarettes, vaping products or any other tobacco-related product. Cigars Amigos does not make, sell or facilitate the sale of cigars. Listings, reviews and directory entries are editorial and informational only, and do not constitute an offer to sell.

Event organisers. If you list an event and accept payment through the Service:

  • you are responsible for delivering the event as described, and for any refunds, cancellations, taxes and licences applicable to it
  • you must be legally entitled to run the event in its jurisdiction, including meeting any age-restriction requirements
  • you must complete identity verification with our payment provider before any funds can be released to you
  • payments from attendees are processed by our payment provider and settled to your connected account, less our commission and the fees of that provider

Payment processing.Payments are processed by a third-party payment provider and are subject to that provider's own terms. We do not store card details. Commission rates are disclosed to organisers before any sale is made.

Enforcement. We may remove any listing, cancel any sale, withhold any payout and suspend or terminate any account where we reasonably believe this section has been breached.

10. Account Termination

We may suspend or terminate your account at any time if you violate these terms. You may delete your account at any time through your account settings. Upon deletion, your data will be permanently removed in accordance with our Privacy Policy.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via the Service. Continued use after changes constitutes acceptance of the modified terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law provisions.
